Direct shipment prohibited, except that an individual may bring in, or receive by direct shipment, up to two cases of wine per month for private use and consumption from states affording Colorado the same reciprocal privilege. Wineries must obtain a shipment permit, $25 annual cost. Advertisement of the availability of products by shipment is prohibited. Orders must be made in person at the licensed premises of the alcoholic beverage licensee. Individuals arriving by air from a foreign country may bring in up to one gallon or 4 liters tax free and without permit. (¶7222)(CR §12-47-126.5). (¶7221)(CRS§12-47-126(3).

On May 2, 1996 House Bill 96-1282, Concerning the Shipment of Alcoholic Beverages, became law. Section 12-47-128(l)(l), C.R.S. was amended to read as follows:

It is unlawful for any person who is a common carrier regulated under Article 10 or 11 of Title 40, of Colorado Revised Statutes, or is an agent or employee of such common carrier, to deliver alcoholic beverages for any person who has not been issued a license or permit pursuant to this article.

Section 1247-126.5 regarding interstate wine shipments into Colorado was amended as follows:

(1) The holder of an alcoholic beverage license that authorizes the manufacture of vinous liquors in a state that affords Colorado adults or licensees an equal reciprocal shipping privilege may ship, for personal use and not for resale, not more than two cases of vinous liquors per month to any adult resident in this state. Delivery of a shipment pursuant to this section shall not be deemed to constitute a sale in this state. The shipping container of any vinous liquors sent into or out of this state under this section shall be clearly labeled to indicate that the package cannot be delivered to a minor, or to an intoxicated person. The holder of an alcoholic beverage license that authorizes the manufacture of vinous liquors in a state other than Colorado may advertise in Colorado the availability of products by shipment to Colorado residents pursuant to the provisions of this section. Any order for a product to be delivered pursuant to this section shall be made by the purchaser in person at the licensed premises of the alcoholic beverage licensee from whom the product is purchased.

(2)(a) Any person authorized under subsection (1) of this section to ship vinous liquors to an adult resident in this state shall obtain a wine shipment permit from the state licensing authority. Applications for wine shipment permits shall be made on forms prepared and furnished by the state licensing authority and shall be filed with the state licensing authority. Applicants shall include such information as the state licensing authority may require to determine whether a permit should issue.

Licensed wineries that reside in reciprocal shipping states should contact the Colorado Liquor Enforcement Division for a "Delivery Permit" application. Permit cost is $25.00, per year, and this fee will be waived for permit applicants who already hold a valid Colorado Wine and Spirits Importers liquor license.
