| The Idaho
State Legislature recently added a new section to
its laws allowing shipments of limited amounts of
wine to Idaho residents for personal consumption from
states affording Idaho reciprocal privileges. Effective
July 1, 1992, any Idaho resident at least 21 years
of age is entitled to receive not more than two (2)
cases of wine per month for personal use from another
state without payment of state tax, fees, or charges
if shipped from a reciprocity state. This also allows
for shipments of limited amounts of wine for personal
use and not for resale out-of-state by licensees holding
an Idaho license for the retail sale of wine for consumption
off the premises if the state to which the wine is
shipped meets certain requirements for reciprocity
and provided labeling and delivery requirements are
met.
The shipping container
of any wine sent into or out of the state must be
labeled to indicate that the container contains
alcoholic beverages and cannot be delivered to a
person who is not at least 21 years of age. The
delivery person must have the person sign for receipt
of wine shipments, not deliver to a minor or one
that is visibly intoxicated, and must retain the
signature for one year (¶7237D-37I-1; Idaho Code§23--1309A).
