Any resident of Oregon who is at least 21 years of age is entitled to receive not more than two cases of wine per month without payment of additional state tax, fees or charges if the state from which the wine is sent allows its residents to receive wine from this state without imposition of state tax, fees or charges. For privilege tax purposes, receipt of a shipment into the state under this subsection is not considered to constitute a sale in the state. No person who transports wine pursuant to this section shall deliver more than two cases of wine to the same address at one time. No person who receives wine pursuant to this section shall resell any of the wine. Out-of-state wine suppliers that supply wine to residents of Oregon must obtain an Out-of-State Wine Shipper License from the Oregon Liquor Control Commission. The license is valid for a period of five years and expires at 12 midnight on December 31 of the fifth year following issuance. An Out-of-State Wine Shipper licensee:
  • (a) may accept written or telephone orders for wine (the licensee must wait until the next day to ship a telephone order);
  • (b) must require the delivery person to:
    • have the person who receives the wine shipment sign for it; verify that the person who receives the shipment is at least 21 years old if the person appears to be under 26 years of age and record the proof of age (driver's license, Motor Vehicles Identification; passport; etc.); and
    • keep the signature record and any proof of age record for one year.

    (c) must comply with all Oregon alcoholic beverage statutes and rules applicable to the sale of wine in Oregon.

There is no charge for this license nor is there a reporting provision. The Commission may cancel or suspend a wine shipper's license for failing to comply with shipment provisions. (O.R.S. Chapter 511;§471.229 approved June 29, 1989, effective October 3, 1989)(¶¶4168;8167).
